Purpose

These Terms apply to your access and use of: (1) our website located at lumoscope.app (the "Website"); (2) our mobile applications ("Apps"); and (3) any services, content, and features made available by us through the Website or the Apps (together with the Website and the Apps, our "Services"). In these Terms, "Lumoscope," the "Company," "we," "us," and "our" refer to Lumoscope and our affiliates, successors, and assigns; and "you" and "your" refer to any user of our Services.

Acceptance of These Terms

Your access and use of our Services are subject at all times to these Terms and our Privacy Policy located at lumoscope.app/legal/privacy, incorporated herein by reference. Please read these Terms carefully. By using the Services, you represent that you are legally able to enter into this agreement. By accessing or using our Services in any way or by clicking to accept or agree to the Terms when this option is made available to you, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of these Terms, do not access or use our Services.

You are responsible for any activity that occurs in your Lumoscope Account, whether authorized or unauthorized by you. So it's important that you take appropriate steps to keep your Account secure (e.g., using strong passwords, keeping your password private, exercising caution when using public or shared devices). We will not be liable for any loss that you incur as a result of someone else using your Account or password, either with or without your knowledge. Description of Service

Lumoscope is an AI-powered astrology application that provides personalized astrological guidance, daily insights and transit interpretations, planet-aligned task management, and electional astrology recommendations. Astrological guidance is for entertainment and self-reflection purposes only. It is not a substitute for professional medical, legal, financial, or psychological advice.

Intellectual Property Rights

The Services and all related content, features, and functionality (including, but not limited to, all information, software, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by Lumoscope, its licensors, or other providers of such material and are protected by UK, EU, and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws as applicable. These Terms are not a sale and does not convey to you any rights of ownership in or related to the Services, or any intellectual property rights owned by us.

Subject to these Terms, you are permitted to access and use the Services for your personal, non-commercial use only. You may not copy, archive, download, upload, distribute, syndicate, broadcast, perform, display, print, monitor, make available, modify, or otherwise use any portion of the Services or the content on the Services except as set forth in these Terms.

Acceptable Use Policy

By using our Services, you agree that:

• •You will not introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
• •You will not attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services;
• •You will not use any part of our Services, or any information available through our Services, to create, train, or otherwise develop any artificial intelligence (or similar) models.

Uploaded Content

Aspects of our Services let you create, upload, post, send, receive, and store content (collectively, "Uploaded Content"). You represent and warrant that you are the owner of, or otherwise have the right to provide, all Uploaded Content that you submit, post, or otherwise transmit through our Services. You hereby grant us a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully sublicensable right and license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute, and/or otherwise use the Uploaded Content in connection with our business.

You understand and acknowledge that you are responsible for any Uploaded Content you post, and you, not Lumoscope, have full responsibility for such Uploaded Content, including its legality, reliability, accuracy, and appropriateness.

By using the Services, you consent to all actions taken by us with respect to your information in compliance with our Privacy Policy.

Terminating or Suspending an Account

We may, for any reason and in our sole discretion, suspend, limit, or terminate your Account and your access to or use of the Services, without notice or liability to you. You may terminate your Account and stop using the Services at any time by notifying us at contact@lumoscope.app. Upon the termination of your Account, you must cease all use of the Services.

Reliance on Information

The information presented through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other user of the Services.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES AND ALL INFORMATION, PRODUCTS, AND OTHER CONTENT (INCLUDING THAT OF THIRD PARTIES) INCLUDED IN OR ACCESSIBLE FROM THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

Limitation on Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SALES OR BUSINESS, LOST DATA OR DATA BREACH, OR (B) FOR ANY DIRECT DAMAGES, COSTS, LOSSES OR LIABILITIES (INCLUDING ATTORNEYS' FEES) IN EXCESS OF THE FEES ACTUALLY PAID BY YOU IN THE TWO (2) MONTHS PRECEDING THE EVENT GIVING RISE TO YOUR CLAIM OR, IF NO FEES APPLY, ONE HUNDRED ($100) U.S. DOLLARS. Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE STATES, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify and hold harmless Lumoscope and its officers, directors, employees, agents and affiliates (each, an "Indemnified Party"), from and against any losses, claims, actions, costs, damages, penalties, fines and expenses, including without limitation attorneys' fees and expenses, that may be incurred by an Indemnified Party arising out of, relating to or resulting from (a) your Uploaded Content; (b) your misuse of the Services; (c) your violation of these Terms; or (d) your violation of any applicable laws, rules or regulations through or related to the use of the Services.

Governing Law

All matters relating to the Services and these Terms and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), will be governed by and construed in accordance with the laws of England and Wales, without giving effect to any choice or conflict of law provision or rule. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

Dispute Resolution

If you are a consumer resident in the UK, nothing in these Terms affects your legal rights as a consumer. If you have a complaint about our Services, please contact us first at contact@lumoscope.app. We will try to resolve any disputes with you directly. If we cannot resolve a dispute, you may have the right to refer the dispute to the courts of England and Wales, or if you are resident in Scotland or Northern Ireland, to the courts of Scotland or Northern Ireland respectively.

For business users, any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Waiver and Severability

No waiver by us of any term or condition set forth in these Terms will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms will not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision will be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

These Terms and any policies or operating rules posted by us on the Apps, Websites or in respect to the Service constitute the entire agreement between you and the Company with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Services.
